Welcome to Clark County Tennis Hub. These Terms of Service govern your access to and use of the website located at clarkcountytennishub.com and any related services, features, content, and applications we offer (collectively, the "Service"). The Service is operated by local volunteers.
1. Acceptance of the Terms
By creating an account, accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Community Guidelines. We may modify these Terms at any time. Your continued use of the Service after any change becomes effective constitutes your acceptance of the revised Terms.
2. Eligibility — Adults Only (18+)
The Service is intended solely for adults who are 18 years of age or older. By creating a profile or otherwise using the Service, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and your use does not violate any applicable law or regulation.
We do not knowingly permit anyone under 18 to register. If we become aware that an account belongs to a person under 18, we will terminate that account.
3. Description of the Service
Clark County Tennis Hub is a local community platform that helps adult tennis players in Southwest Washington find playing partners, post community notices, and discover local courts, coaches, and stringers.
We are a platform, not a participant. We do not organize, supervise, host, attend, or otherwise control any meeting, match, lesson, transaction, or interaction between users or third parties. Any arrangement you make with another person through the Service is solely between you and that person.
4. Accounts and Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information; maintain and update your information; keep your password confidential; be solely responsible for all activity under your account; and notify us of any unauthorized use. We reserve the right to refuse registration or terminate any account at our discretion.
5. Assumption of Risk — In-Person Meetings
The primary purpose of the Service is to connect you with other people, including strangers, whom you may then choose to meet in person. Meeting people you do not know carries inherent risks including physical injury, illness, emotional harm, property damage, theft, fraud, harassment, or other harm.
You knowingly, voluntarily, and freely assume all risks associated with meeting, communicating with, or playing tennis with other users; traveling to any court or facility; participating in any tennis activity; and relying on information provided by other users. You are responsible for evaluating all interactions arranged through the Service.
6. No Background Checks; No Verification or Endorsement
We do not conduct background checks on any user, player, coach, stringer, or other party. We do not verify identity, age, criminal history, qualifications, certifications, character, or fitness of any user or third party. The presence of any person or business on the Service is not an endorsement of any kind.
You are solely responsible for taking reasonable precautions in all interactions with other users and third parties, and for conducting whatever investigation you feel is appropriate before meeting anyone in person.
7. Safety Guidance — Meet in Public Places
For your safety, we strongly encourage you to: meet in public places at courts or parks where others are present; tell someone where you are going and who you are meeting; protect your personal information until you are comfortable sharing it; trust your instincts and leave any situation that makes you uncomfortable; and use the reporting and blocking tools to flag any concerning conduct.
This guidance is provided for your benefit but does not create any duty on our part, and we do not guarantee your safety.
8. User Conduct and Acceptable Use
You agree not to use the Service for any unlawful, fraudulent, or harmful purpose; impersonate any person or misrepresent your identity; post false, defamatory, obscene, or hateful content; harass or harm any other user; collect or misuse other users' personal information; send spam or unauthorized advertising; or introduce malware or attempt unauthorized access to the Service.
9. User Content
You retain ownership of content you post. By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Service. You represent that you own or have the rights to post any content you submit, and that your content does not violate any third-party rights or applicable law. We reserve the right to remove any content at our discretion without notice.
10. Accuracy of Information
We do not warrant the accuracy, completeness, or reliability of any content posted by users or third parties on the Service, including skill levels, availability, contact information, pricing, certifications, or any other user-provided information. You rely on such information at your own risk.
11. Third-Party Services and Links
The Service may contain links to third-party websites, services, or resources. We are not responsible for the content, products, or practices of any third party. Links do not constitute endorsement. Your dealings with third parties are solely between you and them.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF REVENUE, OR ANY OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS OR THIRD PARTIES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100.
14. Release
You release us, and our officers, directors, members, employees, and agents, from any and all claims, demands, damages, losses, and liabilities of every kind arising out of or in any way connected with your interactions, communications, meetings, or disputes with any other user or third party, whether occurring online or in person.
15. Indemnification
You agree to defend, indemnify, and hold harmless us and our officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with your access to or use of the Service; your User Content; your violation of these Terms or applicable law; your interactions with any other user or third party; or your violation of the rights of any third party.
16. Termination
You may stop using the Service and delete your account at any time. We may suspend, restrict, or terminate your account at any time, with or without notice, and for any reason. Upon termination, your right to use the Service immediately ends.
17. Governing Law
These Terms are governed by the laws of the State of Washington. The exclusive venue for any dispute will be the state or federal courts in Clark County, Washington.
18. Dispute Resolution
Before filing any claim, you agree to first contact us at clarkcountytennishub@gmail.com and attempt to resolve the dispute informally for at least 30 days. If unresolved, disputes will be resolved by binding arbitration on an individual basis. You waive the right to participate in any class action proceeding.
19. Changes to the Service
We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation.
20. Changes to These Terms
We may revise these Terms from time to time. Changes are effective when posted. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
21. Miscellaneous
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and us. If any provision is held invalid, the remaining provisions remain in full force.
